Real Housewives of New York star LuAnn de Lesseps is currently in rehab for the second time, and she won’t be going to court this week to face the charges of battery, trespassing, and disorderly intoxication from her arrest on Christmas Eve last year. Instead, her attorney, Douglas Duncan, will appear on her behalf, and the reality star is planning to plead guilty and beg the judge to allow her to avoid jail time.
According to Radar Online, de Lesseps met with Duncan earlier this month to put together a plea deal, and even though she is facing up to two years in jail, de Lesseps is requesting to instead pay $2,500 in fines and serve a mandatory year of probation.
A Florida judge will make a decision on de Lesseps’ plea this week, and a court official says that pleading guilty gives the reality star the best chance to avoid time in jail.
“This gives her more options and probation,” the official said. “If she pleaded not guilty and the judge found her guilty, she would have to face jail time. This is her way of trying to avoid it.”
Florida court documents also reveal that in her plea, de Lesseps is promising to avoid alcohol, attend Alcoholic Anonymous meetings twice a week, complete 50 hours of community service, and attend an Impact of Crimes on Victims Class given by Mothers Against Drunk Driving.
All of these charges against de Lesseps came from her arrest in Palm Beach, Florida last December when she ended up in the wrong hotel room after a night of drinking. When hotel staff couldn’t get her to leave, they called the police, and when they showed up, she allegedly assaulted and threatened to kill an officer.
The 52-year-old recently broke her silence while in rehab by sharing a quote on Instagram that implied she had no regrets.
In addition to her criminal case, de Lesseps is also dealing with a civil suit brought by her ex-husband, Count Alexandre de Lesseps, and their two kids, Victoria and Noel. And, it was that family stress that sent the RHONY star back to rehab.
Her co-star Ramona Singer said at the RHONY reunion taping that things recently came to a really big head for de Lesseps, and she thinks that pushed her over the edge. Singer added that when something like that happens you tend to go back to your demons, and for LuAnn de Lesseps that is alcohol abuse.
