Joe Giudice is in a very bad situation due to his deportation order. As it turns out, there is no way for him to take his four daughters to Italy with him if he really ends up being forced to go back.
One family attorney had a chat with HollywoodLife about the reality TV star’s situation. Here’s what he had to say!
Apparently, he cannot request his daughters with Teresa Giudice, Audriana, 9, Milania, 12, Gabriella, 14 or Gia, 17 to join him to his native country.
New Jersey Family Attorney, Peter G. Aziz explained to the outlet that ‘Joe Giudice isn’t going to be allowed to take his kids out of the country if he is deported. New Jersey uses the ‘Best Interests of the Child’ standards, so it is in the best interest of the kid to stay here because of their age and because they’d be going to a foreign country. There is no way a judge would allow children their age to be removed to another country.’
Aziz went on to say that ‘Joe will get deported before he even gets the chance to file any paperwork. As soon as he finishes the prison sentence he’ll be deported right away, they are not going to let him linger. Unless he files while he is in prison, which… good luck getting any judge to grant it.’
There is still a bit of hope for him as he has until November 9 to appeal the judge’s decision, even though the attorney doesn’t think that will do much.
In the worst case scenario, however, at least ‘His kids would be able to travel and go see him, but he is not going to ever be able to come back. He could file an appeal, but the odds of getting it granted are very unlikely, especially because he is considered a felon, an ex-con.’
‘Even his oldest daughter is not of legal age to make the decision she wants to leave with her father. But at 17 years old, all she needs to do is wait until she is 18 and then she can do whatever she wants.’
