Harvey Weinstein’s attorney, Ben Brafman, filed a motion in court on Friday to dismiss the disgraced producer’s sexual assault case. Brafman argued that grand jurors never saw the exculpatory evidence, including emails from the woman in question who claims Harvey raped her.
The emails allegedly show that the woman was willingly enjoying a relationship with him for years after the supposed rape. Weinstein was indicted for sexual assault charges in New York City in May, and then again in July.
The producer pleaded not guilty and is currently out on a $1 million bail along with GPS tracking, so he can’t leave the country.
Brafman argued in his papers that all of the relationships between Harvey and the women were completely consensual, a claim they have declared from the beginning.
Since the #MeToo movement began last year, approximately eighty women have accused Harvey Weinstein of some form of either assault, harassment, or sometimes even rape.
The result of which was Harvey being indicted on six charges, including first and third-degree rape, as well as first-degree criminal sex acts and an additional two counts of predatory sexual assault.
According to the Los Angeles Times, Brafman’s 159-page motion revealed that the woman who is accusing him of raping her twice had “extensive communications” with him for years afterward, and only started to call it rape afterward, in the heat of the #MeToo movement.

Brafman stated that there were over 400 emails between the two, with many of them being “warm” and “complimentary,” and none of them every indicating any kind of malign or harm done on Harvey’s part, whatsoever.
The emails, between the period of April 2013 and February 2017, said things like, “It would be great to see you again, and catch up!” And in an email in January 2014, she wrote, “you’re the one who makes it look good with your smile and beautiful eyes.”
In another email, she even professed her love for him, and told Mr. Weinstein that she felt like “a booty call.” Brafman said that prosecutors for the Manhattan District, including Attorney Cyrus Vance, ignored this devastating evidence.
